Transparency notices under PA23: a complete guide for contracting authorities

PA23 introduces several new transparency notice obligations. This guide explains what they are, when they are required and how to publish them correctly.

One of the most significant changes in the Procurement Act 2023 is the expanded set of transparency notices that contracting authorities must publish throughout the procurement lifecycle. Unlike PCR 2015, which required relatively few published notices, PA23 requires publication at multiple stages and introduces entirely new notice types.

Pipeline Notice

Required for all planned contracts expected to exceed £2 million. Published on Find a Tender at the start of each financial year. If a new above-£2M contract arises mid-year, a Pipeline Notice is required before the Tender Notice is published.

Tender Notice

The notice advertising the procurement opportunity. Required for all above-threshold procurements. Published on Find a Tender before the procurement opens. Also required on Contracts Finder for contracts above £12,000 in England.

Associated Documents Notice

A new notice type that references the procurement documents associated with a Tender Notice — ensuring all documents are publicly associated with the correct notice on Find a Tender.

Award Notice

Published within 30 days of contract award. Must include: the winning supplier, the contract value, the award date and the evaluation criteria weightings. Failure to publish within 30 days is a breach of the Act.

Contract Details Notice

Published at contract execution. Contains the full contract terms and conditions — introducing a new level of transparency about what has been agreed with the supplier.

Contract Change Notice

Required when a material modification is made post-award. Any change that would have affected the competition is material and requires a notice.

Termination Notice

Required when a contract is terminated early. Must state the grounds for termination.

Common mistakes

  • Publishing Award Notices more than 30 days after contract award — the most common breach
  • Failing to publish Pipeline Notices for contracts over £2M at the start of the year
  • Not publishing Contract Change Notices for contract modifications
  • Publishing notices with incomplete information — partial compliance is non-compliance
